Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Awaken ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Apple Standard EULA

Awaken is licensed to you under Apple's Standard End User License Agreement (EULA). By using the App, you also agree to Apple's terms:

3. Description of Service

Awaken is an iOS alarm clock application that requires users to complete verification activities (math problems, phone shaking, barcode scanning, typing challenges, path tracing, or memory games) before dismissing an alarm. The App includes free and premium features.

4. Subscriptions and Payments

5. Free Trial

Some subscription plans include a free trial period (3 days for Weekly, 7 days for Annual). If the trial is not canceled before the trial period ends, the subscription price will automatically be charged. Free trial eligibility is determined by Apple and may only be available once per Apple ID.

6. Free Tier

Awaken offers a free tier that includes:

Premium features (typing challenge, path tracing, memory game, all themes, video wallpapers, custom backgrounds, and unlimited alarms) require an active subscription.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. Your account can be deleted at any time from the Settings tab within the App.

The App is intended for personal, non-commercial purposes only. You may not:

All content, features, and functionality of Awaken — including but not limited to design, code, graphics, and branding — are owned by Kuba Poprawski and are protected by copyright and other intellectual property laws.

10. Disclaimer of Warranties

Awaken is provided "as is" and "as available" without warranties of any kind, either express or implied. There is no guarantee that:

Users are responsible for configuring device settings (notifications, volume, Focus modes) to ensure alarms function as expected.

11. Limitation of Liability

To the maximum extent permitted by law, Kuba Poprawski shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for missed alarms, lost time, or any other losses arising from use of the App.

12. Changes to Terms

These Terms of Use may be modified at any time. Significant changes will be reflected by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
