Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Awaken ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Apple Standard EULA

Awaken is licensed to you under Apple's Standard End User License Agreement (EULA). By using the App, you also agree to Apple's terms:

3. Description of Service

Awaken is an iOS alarm clock application that requires users to complete a verification challenge before dismissing an alarm. Current challenges include math problems, phone shaking, screen taps, barcode scanning, dance, memory game, photo mission, typing, path tracing, squats, jumping jacks, sky photo, and grass photo. Alarms can also use Random (a different challenge each ring) or Combo (several challenges in order). Photo mission and barcode stay out of Random until they are set up. An optional Wake-Up Check can ask, five minutes after the challenge, whether you are awake, and ring again one minute later if you do not answer. The App includes free and premium features.

4. Subscriptions and Payments

Awaken offers auto-renewable subscriptions (Weekly and Annual) and a one-time Lifetime purchase. The price charged is the price Apple shows for your App Store storefront at the time you confirm the purchase. Lifetime is not a subscription.
Payment is charged to your Apple ID account at the confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Subscriptions can be managed and canceled by going to your device Settings > Apple ID > Subscriptions.

5. Free Trial

Some subscription plans can include a free trial (3 days for Weekly, 7 days for Annual). The App shows a trial only when Apple says that Apple ID is eligible. If a trial is shown and is not canceled before it ends, the subscription price will automatically be charged. Lifetime has no trial. Free trial eligibility is determined by Apple and may only be available once per Apple ID.

6. Free Tier

Awaken offers a free tier that includes:

Up to 2 active alarms
Unlimited math challenge verifications
5 shake verifications per calendar month
5 barcode verifications per calendar month
2 alarm themes (None and Midnight)

Premium features (typing, path tracing, memory game, photo mission, sky photo, grass photo, dance, squats, jumping jacks, all themes, video wallpapers, custom backgrounds, and unlimited alarms) require an active subscription or the Lifetime purchase.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. Your account can be deleted at any time from the Settings tab within the App.

8. Acceptable Use

The App is intended for personal, non-commercial purposes only. You may not:

Reverse-engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works based on the App
Distribute, license, or sell the App or any part of it
Circumvent or attempt to circumvent any security or verification features

9. Intellectual Property

All content, features, and functionality of Awaken — including but not limited to design, code, graphics, and branding — are owned by Kuba Poprawski and are protected by copyright and other intellectual property laws.

10. Disclaimer of Warranties

Awaken is provided "as is" and "as available" without warranties of any kind, either express or implied. There is no guarantee that:

The App will function without interruption or errors
Alarms will fire in all device configurations (e.g., device powered off, battery dead, or system restrictions)
The App will be compatible with all devices or operating system versions

Users are responsible for configuring device settings (notifications, volume, Focus modes) to ensure alarms function as expected.

11. Limitation of Liability

To the maximum extent permitted by law, Kuba Poprawski shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for missed alarms, lost time, or any other losses arising from use of the App.

12. Changes to Terms

These Terms of Use may be modified at any time. Significant changes will be reflected by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
